What is a Motion in Limine?

At trials in Colorado, one job of the Court is to make sure that only relevant or proper evidence is given to the jury.  Normally, this is done at trial.  We see this in movies and on TV all of the time.  One party attempts to introduce evidence.  The other party’s lawyer objects, and the judge rules.

However, some types of evidence could be so damaging to a case that it is important that the jury not hear anything about it.  A partuy can file a Motion in Limine BEFORE trial, asking the judge to rule on the admissibility of the evidence, in a way that avoids potentially prejudicing the jury.
