COBRA, HIPPA and My Medical Benefits
COBRA & HIPPA (the Consolidated Omnibus Budget Reconciliation Act and Health Insurance Portability and Accountability Act) are parts of a broader and complex Federal statute called the Employee Retirement Income Security Act of 1974 (ERISA). ERISA, or the Employee Retirement Income Security Act of 1974, is a complex piece of Federal legislation that deals with employee benefit plans and how employers and their contractors (insurance company) deliver those benefits to employees.
These Acts determine how, when and under what circumstances employees are required to give workers an opportunity to continue receiving needed benefits after a separation in employment (and dictate how insurers and employees handle your confidential medical information). These statutes have many complicated Rules, including how insurance companies and employers are required to “count” the number of days in which they have to provide notice. One misstep, or miscalculation, can lead to a loss of the benefits you and your family have earned (and need).
